Terms of Service

Overview

Welcome to Better You. These Terms of Service ("Terms") govern your access to and use of the Better You website, store, member dashboard, and related products and services (collectively, the "Services").

In these Terms, "we," "us," and "our" refer to Better You. "You" refers to the person accessing or using the Services or buying our products.

By using the Services or buying anything from us, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, and Cancellation Policy. If you don't agree, don't use the Services.

These Terms include important information about your legal rights, including limitations of liability and a medical disclaimer. Read them carefully.

1. Eligibility

To use the Services, you must:

  • Be 18 years of age or older
  • Be a resident of Australia (we don't ship internationally)
  • Not be pregnant or breastfeeding
  • Not be currently managing a diagnosed medical condition without your doctor's approval to use a non-medical wellness service
  • Have the legal capacity to enter into a binding contract

Better You is for healthy adults who want to optimise their performance, recovery, and long-term health. It is not for minors, pregnant or breastfeeding women, or anyone managing a serious medical condition.

If you are unsure whether Better You is appropriate for you, consult your GP before signing up.

2. What Better You is - and what it isn't

Better You is a wellness and performance optimisation service. We use blood biomarker analysis to build personalised supplement formulas designed to support healthy adults within normal physiological ranges.

Better You is not:

  • A medical service
  • A diagnostic service
  • A treatment for any medical condition
  • A replacement for medical care, advice, or supervision
  • A substitute for consulting a qualified healthcare professional

We do not diagnose, treat, cure, or prevent any disease or medical condition. Our biomarker reports highlight where you sit relative to optimal performance ranges — they are not medical diagnoses. Our formulas are designed to support optimisation in healthy adults - they are not medications.

If your blood results suggest a medical issue, we will flag it in your report and recommend you speak with your GP. You are responsible for following up on any medical concerns with a qualified medical professional.

You agree that:

  • You will consult your GP if you have any existing medical condition, take prescription medication, or have concerns before starting Better You
  • You will not rely on Better You for medical advice, diagnosis, or treatment
  • You will not use Better You as a substitute for ongoing medical care
  • Any decisions you make about your health are your own responsibility

3. The blood test and your health information

Better You requires you to provide a blood sample using an at-home Tasso collection kit. By placing an order, you:

  • Consent to providing a blood sample for biomarker analysis
  • Consent to your sample being processed by our partner NATA-accredited Australian pathology lab
  • Confirm you are physically able to safely provide a blood sample
  • Warrant that the information you provide during onboarding (allergies, current medications, dietary requirements, medical conditions, lifestyle factors) is accurate, current, and complete

You are responsible for the accuracy of all health information you provide. We rely on this information to flag potential interactions, allergens, and contraindications when building your formula.

If you provide false, incomplete, or misleading health information, you void our See Your Data guarantee and assume responsibility for any resulting issues.

4. Your account

To access ongoing reports, manage your subscription, and view your formula history, you'll need a Better You account.

You agree to:

  • Provide accurate and current information when creating your account
  • Keep your login credentials secure
  • Not share your account with anyone else (your account contains your personal health data)
  • Notify us immediately at conor@choosebetteryou.com if you suspect unauthorised access
  • Be responsible for all activity that occurs under your account

You may not transfer, sell, or assign your account to any other person. Better You accounts are personal and tied to the individual whose blood was tested.

5. Orders, pricing, and the subscription model

How the subscription works

Better You is sold as a recurring 90-day subscription. Each cycle includes:

  • Your at-home Tasso blood collection kit
  • Lab analysis of 30+ biomarkers
  • Your personalised biomarker report
  • 90 days of custom AM and PM sachets
  • Your next retest kit

You're charged $999 (AUD) at the start of each 90-day cycle. Your subscription renews automatically every 90 days unless you cancel.

Placing an order

When you place an order, you're making an offer to purchase. We accept your order when we confirm acceptance and process payment. We reserve the right to decline or cancel any order at our discretion - for example, if a product is out of stock, if we suspect fraud, or if there's been a pricing error.

Pricing

  • Prices are listed in Australian dollars (AUD) and include GST
  • Prices and promotions can change without notice; the price you'll be charged is the price shown at the time you place your order
  • We may run promotions from time to time; promotional terms govern over these Terms where they conflict

Payment

By placing an order, you confirm:

  • The payment information you provide is true, correct, and complete
  • You are authorised to use the payment method
  • You accept responsibility for all charges incurred under your account, including future subscription charges, until you cancel

Payments are processed by Shopify Payments. We don't store your full card details ourselves.

Cancellation, refunds, and your See Your Data guarantee

  • You can cancel your subscription at any time from your member dashboard. Cancellation takes effect immediately and stops future cycles from being billed. See our Cancellation Policy.
  • Refunds are governed by our See Your Data guarantee and the terms in our Refund Policy.
  • Cancelling and refunding are separate actions. Cancelling alone doesn't refund payments already made.

6. Shipping and delivery

We ship Australia-wide. Shipping is free both ways for every member, every cycle.

  • Kit delivery: typically 1–3 business days after order
  • Sachet delivery: shipped within 48 hours of your formula being compounded, after lab analysis
  • Full first-cycle timeline: approximately 14 days from order to first sachets

Shipping times are estimates only and not guaranteed. We're not responsible for delays caused by shipping carriers, postal services, or events outside our control. Once products are handed to a carrier, title and risk of loss pass to you, except where Australian Consumer Law provides otherwise.

If your shipment is lost or damaged in transit, contact us at conor@choosebetteryou.com within 7 days of expected delivery and we'll arrange a replacement.

7. Intellectual property

The Services, including the website, branding, content, formulas, biomarker analysis methodology, reports, copy, images, and design, are owned by Better You and protected by Australian and international intellectual property laws.

What you can do:

  • Access and use the Services for your personal, non-commercial use
  • Download, save, and share your own biomarker reports and formula breakdowns
  • Take your reports to your GP, trainer, or other healthcare provider

What you can't do:

  • Reproduce, copy, distribute, or modify any Better You content for commercial purposes
  • Use Better You's name, logo, or trademarks without written permission
  • Resell, redistribute, or commercially exploit your sachets, reports, or formulas
  • Republish your formula or analysis as if it were generic supplement advice
  • Reverse-engineer or attempt to replicate our formulation methodology

The "Better You" name, logo, and brand assets are trademarks of Better You. Unauthorised use is a breach of these Terms and may breach intellectual property law.

8. Acceptable use

You agree to use the Services lawfully and respectfully. You may not:

  • Use the Services for any unlawful or fraudulent purpose
  • Misrepresent your identity, age, or health information
  • Share your account or formula with anyone else
  • Resell sachets or kits
  • Take someone else's blood test on their behalf or use someone else's sample
  • Use the Services to harass, abuse, or harm any person
  • Upload viruses, malware, or any harmful code
  • Scrape, copy, or extract data from our website using automated tools
  • Bypass or circumvent any security or access controls
  • Use AI agents, bots, or automated tools to interact with the Services without our written permission

We may suspend or terminate your account at any time, without notice, if we determine you've breached these Terms.

9. Feedback

If you send us feedback, suggestions, ideas, reviews, or comments about the Services, you grant us a perpetual, royalty-free, worldwide licence to use that feedback for any purpose, including marketing, product development, and operations.

You confirm that any feedback you provide:

  • Is your own and doesn't infringe anyone's rights
  • Is accurate
  • Doesn't contain anything unlawful, defamatory, or offensive
  • Discloses any compensation or incentive you received in connection with the feedback (e.g., gifted product in exchange for a review)

We may publish, edit, or remove feedback at our discretion. We have no obligation to respond to feedback or compensate you for it.

10. Errors and inaccuracies

Occasionally there may be errors on our website, typos, incorrect prices, incorrect product descriptions, or out-of-date information. We reserve the right to correct errors and to cancel or adjust orders affected by errors, including after an order has been placed.

If we cancel or adjust an order due to an error, we'll notify you and refund any payment made.

11. Third-party services

The Services rely on third-party providers, including:

  • Shopify for e-commerce and payment processing
  • Our partner pathology lab for blood sample analysis
  • Tasso Inc. as the manufacturer of the blood collection device
  • Australia Post and other carriers for shipping
  • Email, customer support, and analytics platforms

Our website may also link to third-party websites we don't control. We're not responsible for the content, privacy practices, or terms of third-party services or websites. Review their terms before engaging with them.

12. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law (ACL) where such exclusion, restriction, or modification would be unlawful.

You're entitled to consumer guarantees under the ACL that cannot be excluded, including:

  • Goods being of acceptable quality
  • Goods being fit for the purpose disclosed at the time of purchase
  • Services being provided with due care and skill

If our products or services fail to meet a consumer guarantee, you're entitled to remedies under the ACL, including refund, replacement, or repair, and compensation for reasonably foreseeable loss or damage.

13. Disclaimer of warranties

Subject to the Australian Consumer Law and other rights you have that cannot be excluded, the Services and products are provided "as is" and "as available."

To the fullest extent permitted by law, we make no warranties or representations:

  • That the Services will be uninterrupted, timely, secure, or error-free
  • That biomarker analysis will reveal any specific result
  • That any individual will experience specific health outcomes from taking our formulas
  • That the website will be free of viruses or other harmful components
  • About the accuracy, completeness, or usefulness of any information on the website

Where Australian law allows us to limit liability for breach of a consumer guarantee, our liability is limited to (at our option) replacement of the goods or refund of the price paid.

14. Limitation of liability

To the fullest extent permitted by law, and subject to your rights under the Australian Consumer Law:

We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, loss of goodwill, or substitute service costs, arising out of or in connection with your use of the Services or any product purchased from us, regardless of the legal theory (contract, tort, negligence, statutory, or otherwise).

Our total liability to you for any claim arising out of or relating to these Terms or the Services is limited to the total amount you've paid Better You in the 12 months preceding the event giving rise to the claim.

Nothing in this section limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Any liability that cannot be excluded under Australian Consumer Law

15. Indemnification

You agree to indemnify and hold Better You and its officers, directors, employees, contractors, and partners harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of:

  • Your breach of these Terms
  • Your breach of any law
  • False or misleading information you provided to us
  • Your misuse of the Services or our products
  • Your breach of a third party's rights

This obligation does not apply to claims arising from our own negligence or breach of these Terms.

16. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • We are required to do so by law
  • We discontinue the Services

You can terminate your account at any time by cancelling your subscription and emailing us to request account closure.

The following sections survive termination: Sections 7 (Intellectual Property), 9 (Feedback), 12 (Australian Consumer Law), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnification), 17 (Governing Law and Disputes), and any other clauses that by their nature should survive.

17. Governing law and dispute resolution

These Terms are governed by the laws of Western Australia, Australia.

If a dispute arises:

  1. Talk to us first. Email us at conor@choosebetteryou.com. Most issues can be resolved informally within a few business days.
  2. If we can't resolve it directly, you and Better You agree to attempt mediation in good faith before commencing court proceedings, except where urgent injunctive relief is required.
  3. If mediation fails, the courts of Western Australia have exclusive jurisdiction, and you and Better You consent to that jurisdiction and venue.

This clause does not limit your rights under the Australian Consumer Law or your right to lodge complaints with the ACCC, the Office of the Australian Information Commissioner (OAIC), or any other regulator.

18. Changes to these Terms

We may update these Terms from time to time. When we do:

  • We'll update the "Last updated" date at the top
  • For material changes, we'll notify you by email or through the dashboard before the change takes effect
  • Continued use of the Services after a material change means you accept the updated Terms

Past versions are available on request.

19. General provisions

Severability. If any part of these Terms is found unenforceable, the rest stays in effect.

No waiver. If we don't enforce a right under these Terms, that doesn't waive our right to enforce it later.

Entire agreement. These Terms, along with our Privacy Policy, Refund Policy, Cancellation Policy, and Shipping Policy, are the complete agreement between you and Better You. They replace any prior agreements or representations.

Assignment. You can't transfer your rights under these Terms without our written consent. We may assign or transfer our rights without notice, including in connection with a sale, merger, or restructuring of the business.

Headings. Section headings are for convenience and don't affect interpretation.
